Das ist kein juristischer Text. Es gilt die Unschuldsvermutung und Computerprogramme sind urheberrechtlich gesch\u00fctzt. Software ist aus technischer Sicht ein interessantes Gut: Es ist die Transformation einer Idee in einen Algorithmus, dieser Algorithmus wird meist in einer h\u00f6heren Programmiersprache ausformuliert, dann kompiliert, also in ausf\u00fchrbaren Code \u00fcbersetzt, der dann auf einer realen Maschine ablaufen kann. Es ist der Weg von der Idee zu einem lauff\u00e4higen Programm.<\/p>\n\n\n\n

Was nur eine reine Idee ist, was eine individuelle geistige Sch\u00f6pfung ist und ob es f\u00fcr Algorithmen auch Patente geben kann, wird unter Juristen und Informatikern seit vielen Jahren engagiert diskutiert.<\/p>

Der Vorwurf des geistigen Diebstahls hat mehrere Dimensionen, wenige davon thematisieren der Spiegel-Text\u00a0in Ausgabe 46\/2021 und ein Bericht im ARD-Fernsehmagazin Fakt vom 16. November dieses Jahres \u2013 leicht zu googlen mit: ARD MDR FAKT SAP.<\/p>\n\n\n\n

Der banale Kern des Vorwurfs lautet: SAP habe mithilfe eines Universit\u00e4tsinstituts in Nachbars Garten geschaut. Offensichtlich wurde beauftragt, Software des Mitbewerbers zu analysieren. F\u00fcrs Erste also klassische Mitbewerberbeobachtung, \u00e4hnlich dem Umstand, wenn VW-Chef Herbert Diess in einem Tesla ein paar Runden dreht, um zu erproben, ob Kollege Elon Musk echte Autos bauen kann. Wahrscheinlich sind alle europ\u00e4ischen Autobauer in einem Tesla gesessen, um sich ein paar Ideen zu holen, und dann haben die Ingenieure wohl auch die Motorhaube ge\u00f6ffnet.<\/p>\n\n\n\n

Die praktische Vernunft besagt nun, dass sowohl der Tesla f\u00fcr Elon Musk als auch Harry Potter f\u00fcr Joanne Kathleen Rowling als auch eine spezifische In-memory-Computing-Datenbank f\u00fcr Teradata den Umstand des geistigen Eigentums in sich tragen. Zum Schutz der individuellen geistigen Sch\u00f6pfung darf niemand einen Tesla kopieren, einen Harry-Potter-Roman schreiben oder die Software von Teradata umprogrammieren.<\/p>\n\n\n\n

Der Konfliktfall entsteht nun nicht aus der Tatsache, dass dem Tesla neue Felgen verabreicht werden und das Dach demontiert wird, um ein Cabrio zu bekommen \u2013 was in jedem Fall ein Eingriff in Elon Musks Sch\u00f6pfung ist. Es entsteht auch kein Diebstahl geistigen Eigentums, wenn ein Harry-Potter-Buch zu einer Pappmascheeskulptur verarbeitet wird, was eventuell nicht dem Geschmack von Joanne Kathleen Rowling entspricht. Aber die Urheberschaft ist laut Gesetz verletzt, wenn Software r\u00fcck\u00fcbersetzt wird (dekompiliert) in eine beliebige Programmiersprache, die der geistige Sch\u00f6pfer eventuell nicht einmal beherrscht und lesen kann.<\/p>\n\n\n\n

Die juristische Definition, was mit Software geschehen darf, f\u00fchrt zum Konfliktfall und nicht die Tatsache, ob hier eine individuelle geistige Sch\u00f6pfung vorliegt. Dieser Umstand wird hervorragend in einem CT-Artikel (Heise) in 24\/2021 auf Seite 172 beschrieben. Laienhaft zusammengefasst: Mit der Lizenz einer Software hat man kaum Rechte. Definitiv darf nicht untersucht werden, was hier erworben wurde. Ob es sich um ein Plagiat oder eine individuelle geistige Sch\u00f6pfung handelt \u2013 es ist verboten, die Software zu dekompilieren. \u201eEbenso gesch\u00fctzt sind die Rechte auf \u00dcbersetzung, Bearbeitung, Arrangement und anderweitige Umarbeitungen\u201c, schreibt CT. Einem Tesla neue Felgen und einen Spoiler zu spendieren, scheint erlaubt zu sein, einem Computerprogramm mehr Power zu vermachen, jedoch nicht.<\/p>\n","protected":false},"excerpt":{"rendered":"
