New guide to data protection
The Bitkom guideline on the "Transfer of personal data - domestic, EU countries, third countries", which has been in existence for some time now
is available in an updated version.
The ECJ ruling on Safe Harbor in autumn 2015 and the protracted negotiations on the successor Privacy Shield until the summer of last year led to some uncertainty regarding the requirements for data transfers to the USA and other third countries.
The new Bitkom guideline provides an overview of what generally needs to be considered when transferring data.
Current developments have been incorporated on the basis of the applicable legal situation under the General Data Protection Regulation.
The guide is intended to provide orientation for the period up to May 25, 2018. There will be a further revision in good time before this date - then completely based on the EU regulation.
